Consumer Protection Act, 2019 – Main aim to protect the rights of consumers by establishing authorities for timely and effective administration and settlement of consumer disputes.
A consumer is defined as a person who buys any good or hires or avails a service for a consideration. It does not include a person who obtains a good for resale or a good or service for commercial purpose. It covers transactions through all modes including offline, and online through electronic means, teleshopping, multi-level marketing or direct selling. However, Person buying any good or availing any service for the purpose of earning his livelihood by means of self employment is a consumer.
Rights of the consumer –Deficiency means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service and includes—
The act has the provision of the establishment of the Consumer Disputes Redressal Commissions (CDRCs) at the national, state and district levels. Complaints against an unfair contract can be filed with only the State and National Appeals from a District CDRC will be heard by the State CDRC.
